Terms of Service

These Terms govern your use of Qruuk. By creating an account or using the service you agree to them. If you use Qruuk on behalf of a business, you confirm you are authorised to bind that business.

1. The service
Qruuk lets a business create and run digital loyalty programs, passes and tickets: QR codes customers scan, cards they keep in their browser, staff validation, an audience and marketing tools, an API and webhooks. We may add, change or remove features over time.
2. Accounts
- You must give accurate information and keep your login secure. You are responsible for activity under your account.
- You must be able to form a binding contract and use Qruuk only for lawful business purposes.
- API keys and webhook signing secrets are credentials — keep them secret and rotate them if exposed.
3. Your customers' data — your responsibility
When you collect and process your customers' personal data through Qruuk, you are the data controller and Qruuk is your processor. You are responsible for having a lawful basis to store your customers' details, for honouring their rights, and for obtaining valid marketing consent before marketing to them. Qruuk keeps marketing consent separate from program signup and provides erase, export and unsubscribe tools to help you comply. See our Privacy Policy.
4. Acceptable use
- No unlawful, deceptive, or infringing use; no sending unsolicited marketing without consent.
- No attempts to break, overload, or reverse-engineer the service, or to bypass plan limits or rate limits.
- No using the API or webhooks to build a competing product from Qruuk's data about other businesses.
5. Plans, fees and usage
- Qruuk offers Free, Core and Pro plans with the limits shown in the app and on our pricing page.
- Paid plans are billed in advance on a recurring basis. Usage-based charges (for example beyond an included quota) are billed in arrears per our pricing.
- Fees are exclusive of applicable taxes. Except where required by law, fees already paid are non-refundable.
- We may change pricing with reasonable notice; changes take effect at your next billing period.
6. Intellectual property
Qruuk and its software are owned by the provider. You keep ownership of your content and your customers' data. You grant Qruuk the limited licence needed to host and process that data to provide the service.
7. Availability and disclaimer
We work to keep Qruuk available and reliable but provide it "as is" without warranties of any kind to the extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.
8. Limitation of liability
To the extent permitted by law, Qruuk is not liable for indirect or consequential losses, or for lost profits or data. Our total liability for any claim is limited to the fees you paid for the service in the [12] months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
9. Term and termination
- You may stop using Qruuk and delete your account at any time from within the app.
- We may suspend or terminate access for breach of these Terms or non-payment, with notice where practical.
- On termination we delete or return your data as described in the Privacy Policy, subject to legal retention.
10. Governing law
These Terms are governed by the laws of [Estonia], and disputes are subject to the courts of [Harju County, Estonia], without affecting mandatory consumer protections in your country of residence.
11. Changes
We may update these Terms; we will change the effective date and, for material changes, notify account owners. Continued use after changes means you accept them.
